Services Covered Under These Terms

These Terms of Service apply to all Roll-off Dumpster & Portable Bathroom Rentals provided by Budget Dumpster Pros in and around New York, NY 11229. Services include delivery, placement, pickup, and disposal of roll-off containers sized 10-yard, 20-yard, 30-yard, and 40-yard. Portable restroom rentals cover standard porta potties, ADA-compliant units, and luxury restroom trailers with hand wash stations. Each rental agreement specifies the weight allowance, drop window, and service interval. Exclusions require a separate agreement: hazardous waste (tires, batteries, paint), septage pumping beyond normal portable toilet servicing, and placement requiring a street permit beyond a standard 24‑hour municipal processing window. Many cities require a Right-of-Way permit for any container placed on a public street or sidewalk; the customer is responsible for securing such permits unless otherwise arranged. DOT regulations govern transport weight limits, typically capping loaded containers at 10 tons. OSHA 1926.51 requires toilet facilities on construction job sites for crews of any size; our portable restroom rentals help meet that standard. Materials like asphalt shingle tear-off debris (weighing 250–400 pounds per square) and mixed construction debris are within scope, but concrete, brick, or dirt loads require a dedicated heavy debris dumpster and may incur tonnage overage fees.

Scheduling and Cancellation Policy

Appointments for dumpster delivery or portable restroom setup are scheduled during business hours; we provide a drop window for each placement. Changes to the delivery date or container size must be approved at least 24 hours before the scheduled drop. Cancellations made less than 48 hours before the drop window may incur a fee equal to the delivery charge. For events or long-term construction rentals, the rental period begins on the delivery date and runs until pickup. If a job runs longer than the agreed rental period, additional days will be billed at a daily rate. Customers must ensure clear access for the roll-off truck with hook-lift or cable-lift hoist system; blocked driveways or low-hanging wires may delay service. Street placement requires a municipal permit obtained by the customer; we can guide you on the 24–72 hour processing timeline. If a portable toilet servicing is missed due to site inaccessibility, a rescheduling fee may apply. Scope changes mid-rental (e.g., upgrading from a 20-yard to a 30-yard dumpster) require written approval from our team.

Estimates and Payment Terms

Quotes for Roll-off Dumpster & Portable Bathroom Rentals are based on container size, weight allowance (typically 3–4 tons for a 20-yard dumpster), rental duration, and distance from our yard in New York, NY 11229. Payment is due at the time of delivery unless a credit account is established. We accept major credit cards and cash. Final pricing may adjust if the loaded weight exceeds the included tonnage; overage fees are calculated per ton based on the weight ticket from the transfer station or municipal landfill. Concrete heavy debris loads are priced separately due to higher disposal costs. For portable restroom rentals, a 28-day billing cycle minimum applies; weekly service intervals include pumping and restocking of toilet paper and hand sanitizer. Any additional services such as emergency pump-outs or after-hours delivery will be quoted and require approval before work begins. We do not charge hidden fees; all applicable permit charges, environmental fees (e.g., EPA Resource Conservation and Recovery Act hazardous waste exclusion handling), and fuel surcharges are disclosed in your estimate.

Workmanship Warranty Coverage

Budget Dumpster Pros stands behind the delivery, placement, and pickup of our dumpsters and portable restrooms. If a container is dropped crooked, blocks a necessary access point, or causes damage to a driveway due to our negligence (e.g., no surface protection boards under dumpster casters), we will correct the issue at no charge. This warranty covers workmanship for the duration of the rental period. For portable restrooms, we guarantee the unit is clean, stocked, and functional upon delivery; any malfunction such as a broken lock or a wash station running dry will be addressed within 24 hours of notification. What voids coverage: customer overloading the container beyond the specified weight limit, placing prohibited materials (hazardous waste, liquids, sealed drums), or moving the dumpster without authorization. Winter conditions like frost penetration affecting porta potty stability are considered site issues and not covered under warranty. This warranty does not extend to damage caused by third parties (e.g., vandalism, vehicle impact) or pre-existing surface cracks.

Limitation of Liability

Our liability is limited to the total amount paid for the specific rental service giving rise to a claim. We are not liable for any indirect, incidental, or consequential damages arising from the use of dumpsters or portable restrooms, including but not limited to property damage from overfilled containers, odors from units in hot weather, or delays caused by municipal permit processing. We are not responsible for pre-existing conditions on site (e.g., underground utilities, weak asphalt) or for damage resulting from customer failure to secure a street permit when required by local Public Works or Streets Department. Where container placement on a public street is involved, the customer assumes risk of fines or towing if no permit is obtained. DOT regulations set transport weight limits, and we will not be liable for overweight loads if the customer loads beyond the agreed tonnage. By renting from us, you acknowledge that OSHA compliance for jobsite sanitation (OSHA 1926.51) and ADA accessibility requirements for public events are the customer’s responsibility to oversee; our equipment rental supports compliance but does not guarantee it.
